He could not sell the band’s land. No tribe thought it owned the land. The whites did not recognize this way of life. They often dealt with the leader of a band. They acted as though he were the chief of the whole tribe. They got him to sign a treaty. The treaty allowed the whites to gain the land they wanted. Image Credit: Library of Congress In 1864, the Northern Pacific Railroad received a charter to build on Nez Percé and Sioux lands that lay between Lake Superior and the Pacific Ocean. The charter clearly violated many treaties.

They slaughtered cows, taking only choice cuts. They carried away colts and calves. Over two weeks, whites stole thousands of head of cattle. When Joseph complained, white sheriffs did nothing to help the Nez Percé. At night the councils continued. Some argued there were too many whites to fight and win. Others said that if the Nez Percé won battles, the whites would then leave them alone. To reach the reservation, the Nez Percé had to cross the Snake River with their belongings and herds. The quarter mile-wide river was in flood.
